April 23rd, 2007

 

Pursuant to due call and notice thereof, a regular meeting was held on Monday April 23, 2007 at 6:00 P.M. in the Crosby City Council Chambers. The Pledge of Allegiance was given. The meeting was called to order by Mayor Sova with Member Erwin Neprud, Member Debra Shankle, Member Edward Vukelich and Member David Ferrari present.

MOTION MADE BY MEMBER VUKELICH AND SECONDED BY MEMBER SHANKLE TO APPROVE THE MINUTES AS PRESENTED. Motion carried.

The Mayor Dale Sova passed statement of the March 12, 2007 minutes that he is not waiting any longer for them.

Additions to the agenda:

Member Ferrari under Public Works

It was noted that due to the untimely passing of Jinx Ferrari, three members of the council will be attending the funeral and an open meeting law warning was given. The Mayor noted the members would be in different areas of the service.

PUBLIC COMMENTS

Charles Sellers of the Planning and Zoning Commission asked if I t showed where the motion asked for Augusta Housing applicant Mark Held to find an alternative to a ditch and to show the twenty foot setback.

UNFINISHED BUSINESS

Park Restrooms

The State Health Department has reviewed the application and informed Member Shankle that the application will be returned due to requirements plans still need to meet. As of yet the revisions have not reached Member Shankle or the City Clerks Office. Member Shankle called for clarification of the bidding process. Must she wait to get the final approval back from the state or can she publish for bids at the same since it must be published for fifteen full days. To control change orders, it was suggested to await the acceptance of the revisions the state set forth to the original application and then publish for bids. If change orders are required because the plans change because of what the state may require, the contractor can charge for them, which in turn increases our cost.

Playground

All is going smooth.

Riverton Playground Equipment

MOTION MADE BY MEMBER NEPRUD AND SECONDED BY MEMBER VUKELICH FOR THE MAYOR TO SIGN THE AGREEMENT TO MOVE THE PLAYGROUND EQUIPMENT ONCE RIVERTON IS PLACED INT TH AGREEMENT AND IRONTON IS REMOVED. Motion carried.

REPORTS

Fire Department

Fire Chief Leonhardt was absent due to work schedule

Police Department

Police Chief Coughlin stated the department is set to assist with the Jinx Ferrari services.

The dog ordinance and the criminal history ordinance were both tabled to the next agenda.

Attorney’s Report

Attorney Gammello reported the union ratified the Police contract.

MOTION MADE BY MEMBER NEPRUD AND SECONDED BY MEMBER VUKELICH TO SIGN THE POLICE CONTRACT. Motion carried.

The attorney noted that the language of “past practices” is vague and restrictions are placed upon vague language. The council can ratify the contract or meet and re negotiate the language of “past practices”.

MOTION MADE BY MEMBER VUKELICH AND SECONDED BY MEMBER FERRARI TO APPROVE THE MAYOR’S SIGNATURE FOR THE PUBLIC WORKS CONTRACT WITH THE LANGUAGE CHANGE. Motion carried.

The attorney extended his appreciation to the nice job done by the negotiation committee.

A developer’s agreement needs to be in place for the Augusta Housing project.

MOTION MADE BY MEMBER NEPRUD AND SECONDED BY MEMBER VUKELICH TO APPROVE OUR CITY ATTORNEY TO SEND A COPY OF THE DEVELOPER’S AGREEMENT TO THE DEVELOPER AND COMMUNITY GROWTH INSTITUTE. Motion carried.

Friday April 27, 2007 the city attorney will meet with a group representing the Cuyuna Senior Housing Campus. Committee members attending will be Mayor Sova and Member Ferrari. The purpose is to negotiate the utilities.

A response and a listing of professional fees will be compiled and sent back to Michael Halley of Halley’s Custom Homes

Public Works

MOTION MADE BY MEMBER VUKELICH AND SECONDED BY MEMBER SHANKLE TO APPROVE FOUR THOUSAND DOLLAR OUT OF THE ADVERTISING BUDGET FOR TIM KOSTAL TO DO THE SIGN ON MAIN STREET. Motion carried.

Cold Weather ruling  water shutoffs are all done.

The hole by Immanuel Lutheran Church is back. It was also decided that Member Neprud and Supervisor Booth will explore for other areas that need fill too.

The City wide cleanup is set for Saturday May 5, 2007. Another open meeting warning was given.

The bill from Irondale due to a resident on our water run program that created an icy condition on an Irondale road that was so immense Irondale had to clean it up was discussed and tabled.

The rules of Memorial Day for cemetery maintenance are to be printed into the paper.

The park areas to be fixed are a broken fence, tress to come down and trimmed and the piles of leaves at the Hallett Park.

Engineer’s Report

Seal coat bids

The contacts are out and the advertisement will go into the paper to get estimates for Fourth Street.

The hospital utilities contract is finished and e-mailed to Jac McTaggart. He also stated that Widseth Smith and Nolting will be at the utilities meeting on the 27th.

Clerk’s Report

Cindy is still ill and will bring a note once she is able to return to work.

The idea of looking into a City Manager was briefly mentioned. The League of Minnesota Cities could be called and they could assist in looking g into see how other cities do hire city managers.

Mayor and Committee Reports

The Serpent Lake Sanitary Sewer District has no written by-laws on file. Although, it is noted that two members from each city are asked to sit on the board it just so happened that they all went with council members and it is not stated that they must be council members. The members are from Crosby, Ironton, Cuyuna, and Deerwood.
